UK competition agency threatens inquiry into banks (AP)

LONDON ? Britain's big banks could face a full-blown monopoly investigation if they drag their heels on opening up to competition, a national regulator warned Thursday.

Banks must act to make it easier for customers to understand various charges and to switch to other banks if they choose, said John Fingleton, head of the Office of Fair Trading.

If the situation doesn't improve, Fingleton said, his agency could refer the banking industry for an investigation by the Competition Commission. That agency has the power to force a break up of private companies, as it has done in ordering BAA Ltd. to sell Gatwick, Stansted and Edinburgh airports.

"A step change is needed in the banking sector," Singleton said in a speech to a seminar organized by market intelligence company MLex and Lloyds Banking Group.

"Going forward we need to see evidence which demonstrates that the market dynamics of entry and switching are sufficient to drive stronger customer-focused competition. Without this the obvious question is whether the concentrated market structure of UK banking is the problem.

"And one way to consider this question is a reference to the Competition Commission."

Fingleton suggested that a possible referral could come after his agency's review of the personal current account market which is to begin later this year.

The British Bankers Association said research shows that "the vast majority of customers are satisfied with the service their bank provides and there is no reason for them to switch accounts.

"Similarly, there is no evidence that customers want to move away from the current 'fee free if in credit' model to one where every customer pays for every transaction, as is the case in virtually every other country," said BBA spokesman Brian Capon.

Shares fell in the banking sector as Moody's Investors Service announced that three British giants ? Barclays, HSBC and part-nationalized Royal Band of Scotland ? remained under review for a possible downgrades of their credit ratings. HSBC and RBS were both down more than 1 percent by early afternoon.

Banks already face a major restructuring, as the government announced in December it would legislate to require banks to isolate their unglamorous retail operations from their more volatile investment banking activity. Treasury chief George Osborne says that legislation is aimed as solving the problem of banks being "too big to fail."

Fingleton pointed to the part-nationalized Lloyds Banking Group as an example of how the fallout from the credit crisis had led to less competition.

Lloyds' takeover of Halifax/Bank of Scotland, rescuing it from collapse, had eliminated HBOS as a major competitor in the personal current account market, he said.

"The Lloyds-HBOS merger increased concentration in an already highly concentrated and non-dynamic market, he said.

Beyond making it easier for customers to switch banks, Fingleton said banks should make it easier for customers to understand the true costs of their accounts.

A study by his agency "found that consumers paid little attention to unarranged overdraft charges and forgone interest" which make up the vast bulk of banks' revenues, Fingleton said.

OU football schedule finalized: Sooners open at UTEP, host Florida A&M

This year, the Sooners will start out in the desert mountains of El Paso as OU opens the 2012 season at UTEP on Sept. 1.

The Sooners? schedule was finalized just this week and the school announced the dates Wednesday morning.

The Miners are the Sooners? first true road opponent since 1994, when Gary Gibbs? final OU team started the season with a 30-29 victory at Syracuse.

OU also started on the road in 2002, but a swarm of Sooner fans overran Tulsa?s Skelly Stadium in a 37-0 Oklahoma triumph.

Oklahoma opened the 2009 season against BYU at Cowboys Stadium in Arlington, Texas, a 14-13 loss in which quarterback Sam Bradford suffered a shoulder injury. Four of OU?s five losses that season were by a touchdown or less, and the Sooners finished with a 31-27 win over Stanford in the Sun Bowl in El Paso.

A week after starting at UTEP, OU hosts Florida A&M on Sept. 8. It?s just the third time under coach Bob Stoops the Sooners have had to resort to playing a school from the Football Championship Subdivision (formerly I-AA; the others were Indiana State in 1999 and Tennessee-Chattanooga in 2008).

It's believed UTEP will return multiple home games to Norman, though details of the contract were not released and athletic director Joe Castiglione was unavailable for comment.

The unusual nature of each of OU?s first two games this season underscores the difficulty Castiglione has had in trying to find opponents. Uncertainty from ongoing conference realignment, coupled with the rising costs of paying opponents to come to Norman (OU paid Ball State $900,000 last season) have made it tougher than most years.

?We have a philosophy of playing a challenging schedule on a yearly basis that puts our team in the best possible situation to make a run at a championship,? coach Bob Stoops said in a press release. ?I know that Joe Castiglione puts our program?s best interests at the forefront when scheduling our opponents and it shows with the quality of teams on our schedule.?

The Big 12 Conference finalized its 2012 schedule on Tuesday. That process was dragged out because of ongoing litigation between West Virginia and the Big East Conference, who sued each other over WVU?s decision to leave the Big East for the Big 12.

When the Mountaineers and Big East came to an accord, the Big 12 quickly revealed its conference schedule, which then freed up Oklahoma to follow suit on its non-conference slate.

OU?s other non-conference game is a home contest against Notre Dame on Oct. 27.

That game, part of a two-year contract that sends the Sooners to South Bend, Ind., in 2013, became locked in early, leaving OU with two open dates in September: Sept. 15 and Sept. 29. After that, the Sooners play nine consecutive Saturdays.

That includes a finishing stretch against defending Big East and Orange Bowl champion West Virginia in Morgantown, W.Va., against defending Big 12 champion and Fiesta Bowl Oklahoma State in Norman, and against defending Mountain West Conference and Poinsettia Bowl champion Texas Christian University in Fort Worth.

?We look forward to another challenging year,? Stoops said, ?and hope our fans reflect the excitement we have for this year?s schedule.?

OU has never played a regular-season game at Sun Bowl Stadium, but is 3-0 in bowl games there, and is 2-0 all-time against UTEP (both in Norman).

This season also marks the first meeting between the Sooners and Florida A&M.

The Fighting Irish are 8-1 in the all-time series against OU, but haven?t played at Owen Field since 1966.

Could Mother Nature disrupt your business? This is an old tale for many companies who make their homes in states that regularly experience extreme weather ? but what about the rest of us?

The past year brought some of the most severe weather on record including Hurricane Irene, which tracked over the Northeast this past August, leaving behind some of the worst flooding and storm damage the region had experienced in over 70 years.

Then, in October the Northeast was hit again with an unseasonable blizzard that left 32 inches of snow and 1.6 million without power. The South and Midwest have been plagued with droughts and tornados, and even warm weather climates like Hawaii reported snowfall last year.

As extreme weather becomes more widespread, we need to prepare our businesses, just as we would our homes, for the unexpected. Having a disaster preparedness plan, including backup and recovery for critical systems, will help your organization mitigate risk and maintain corporate compliance, even in the event of a natural disaster.

Is Your Business Prepared?

Could your business recover in the event of an extreme weather occurrence or natural disaster? Centralization is not just about improving access and control, but also about making it easier to standardize by bringing everything together in one place so you can more easily view and respond to any overlaps, inconsistencies and gaps. Furthermore, it helps improve reporting by providing a holistic view of your business resilience program at any point in time.

As we?ve learned with all the events of this past year, Mother Nature can be fickle. Even with plenty of warning of what?s coming, you can?t always be sure your assets will be protected. Your best option is to have a solid plan that keeps your most critical operations running and that you have a team of people trained to implement it.

Once you have identified how to improve your BC/DR and crisis management plan, you are well on track to ensuring the readiness of your company.

As I touched on earlier ? communication and collaboration is of the utmost importance. You need to ensure a common understanding across departments of the processes, assets and functions that are the important to the business and, therefore, to its customers. This understanding is what will underpin the risk-rating and BIAs that will drive your preparedness planning.

Next is tying together people, processes and technology to avoid conflicts, gaps and wasteful overlaps. Specialist software tools can support this effort by streamlining workflows and making it easy for non-technical users to carry out activities like running real-time reports. These tools also typically provide the central repository you need for all your documented output.

Finally, training and testing are absolutely vital to a solid disaster preparedness plan. What good is a robust plan, if no one knows what to with it?

True preparedness depends on knowing exactly what to do, when to do it and how to do it. There is no second chance when a disaster strikes, only lessons learned.
