A Central New York mayor resigns after being caught with an open can of been in his car.

EARLVILLE, CHENANGO CO. -- A Central New York mayor has resigned?after being caught with an open can of beer in his car.

On Wednesday night, Mark Doeberl resigned as mayor of the village of Earlville. The village board of trustees?held a special meeting?where Doeberl gave his resignation.

Last Friday,?Doeberl was stopped at a DWI checkpoint. Police found an open can of beer in his car and say his breath smelled of alcohol.

Deputy Mayor William Excell will now step in as mayor of the village and will remain mayor until March when he says an election will be held. Excell tells CNY Central that he is ready to become mayor and plans to run for the position during the next election.

Execell tells us Doeberl regretted leaving his post as mayor but needed to resign because of personal reasons.

Worst year in decades for elephants (AP)

JOHANNESBURG ? It's been a disastrous year for elephants, perhaps the worst since ivory sales were banned in 1989 to save the world's largest land animals from extinction, the wildlife trade monitoring network TRAFFIC said Thursday.

A record number of large seizures of elephant tusks represents at least 2,500 dead animals and shows that organized crime ? in particular Asian syndicates ? is increasingly involved in the illegal ivory trade and the poaching that feeds it, the group said.

Some of the seized tusks came from old stockpiles, the elephants having been killed years ago. It's not clear how many elephants were recently killed in Africa for their tusks, but experts are alarmed.

TRAFFIC's elephant and rhino expert Tom Milliken thinks criminals may have the upper hand in the war to save rare and endangered animals.

"As most large-scale ivory seizures fail to result in any arrests, I fear the criminals are winning," Milliken told The Associated Press.

Most cases involve ivory being smuggled from Africa into Asia, where growing wealth has fed the desire for ivory ornaments and for rhino horn that is used in traditional medicine, though scientists have proved it has no medicinal value.

"The escalation in ivory trade and elephant and rhino killing is being driven by the Asian syndicates that are now firmly enmeshed within African societies," Milliken said in a telephone interview from his base in Zimbabwe. "There are more Asians than ever before in the history of the continent, and this is one of the repercussions."

All statistics are not yet in, and no one can say how much ivory is getting through undetected, but "what is clear is the dramatic increase in the number of large-scale seizures, over 800 kilograms (1,760 pounds) in weight, that have taken place in 2011," TRAFFIC said in a statement.

There were at least 13 large seizures this year, compared to six in 2010 with a total weight just under 1,000 kilograms (2,200 pounds).

In the most recent, and worst, case Malaysian authorities seized hundreds of African elephant tusks on Dec. 21 worth $1.3 million that were being shipped to Cambodia. The ivory was hidden in containers of handicrafts from Kenya's Mombasa port. Most large seizures have originated from Kenyan or Tanzanian ports, TRAFFIC said.

Fifty elephants a month are being killed, their tusks hacked off, in Tanzania's Selous Game Reserve, according to the Washington-based Environmental Investigation Agency.

With shipments so large, criminals have taken to shipping them by sea instead of by air, falsifying documents with help of corrupt officials, monitors said.

Milliken said some of the seized ivory has been identified as coming from government-owned stockpiles ? made up of confiscated tusks and those of dead elephants ? in another sign of corruption.

"In 23 years of compiling ivory seizure data ... this is the worst year ever for large ivory seizures. 2011 has truly been a horrible year for elephants," said Milliken.

Rhinos also have suffered. A record 443 rhino were killed in this year in South Africa, compared to 333 last year, according to National Geographic News Watch. South Africa is home to 90 percent of the rhinos left on the continent.

Africa's elephant population was estimated at between 5 million and 10 million before the big white hunters came to the continent with European colonization. Massive poaching for the ivory trade in the 1980s halved the remaining number of African elephants to about 600,000. Following the 1989 ban on ivory trade and concerted international efforts to protect the animals, elephant herds in east and southern Africa were thriving before the new threat arrived from Asia.

A report from Kenya's Amboseli national park highlighted the dangers. There had been almost no poaching in the park, which lies in the shadow of Mount Kilimanjaro, for 30 years until a Chinese company was awarded the contract to build a highway nearby two years ago. Amboseli has lost at least four of its "big tuskers" since then.

Quiznos Restructures Debt to Avoid Chapter 11

Quiznos Corp., the closely held sandwich chain, reached an agreement with creditors that may help it avoid bankruptcy.

The restructuring deal with a ?significant majority? of first- and second-lien lenders will provide $150 million in new equity capital, the Denver-based company said Friday in a statement. The pact will cut $300 million from Quiznos? debt load, almost one-third of the total, and make Avenue Capital Group LLC the majority owner.

Quiznos will shelve a backup plan to file for Chapter 11 bankruptcy if it can persuade all of the lien holders to accept the restructuring. The company also intends to ask for concessions from other creditors, it said in the statement.

?The terms of the pre-packaged Chapter 11 plan would provide less favorable treatment for the lenders and certain other creditors and landlords than under the proposed out-of- court exchange offer,? the company said.

Quiznos owners include CCMP Capital Advisors LLC, Quiznos founder Rick Schaden and Consumer Capital Partners, the private equity firm he started.

Minister: Spain to fall back into recession (AP)

MADRID ? Spain will slide back into recession early next year with the current quarter and the first of 2012 both registering negative growth, new Economy Minister Luis de Guindos said Monday.

De Guindos said he expects the economy ? the eurozone's fourth largest ? to contract by between 0.2 percent and 0.3 percent on the previous quarter in the final three months of this year and again in the first quarter of next year. He said the outlook for next year was poor.

If the Spanish economy were to contract by between 0.2 percent and 0.3 percent for an entire year, it would shrink roughly 1 percent.

"Let nobody be fooled, the next two quarters are not going to be easy either in terms of growth or employment," de Guindos said.

Spain began to emerge from a near two-year recession last year. It had two successive quarters of growth in 2011 before posting zero growth in the third period.

De Guindos took office last week as part of the new conservative Popular Party government. He said then he was confident the country would emerge from its severe economic crisis and return to prosperity and its former status as a job creator.

Spain has the highest unemployment rate of the 17 countries that use the euro, with 21.5 percent joblessness, and is running a swollen budget deficit following the recession that started with the collapse of a real estate bubble.

The Popular Party won a landslide victory in Nov. 20 elections on a promise to get the economy moving again.

Prime Minister Mariano Rajoy has pledged austerity cuts totaling euro16.5 billion ($21.6 billion) and promised labor reforms.

His government is to begin approving urgent measures Friday, including a freeze on filling new civil service vacancies. except in key areas such as the security forces.

Spain has already made sharp cuts to its national spending and introduced several reforms under the former Socialist government, but the economy has failed to respond.

North Korean Officials Consider Defecting, Some Delay Leaving China

With the North Korean government in a moment of transition following the death of ?Dear Leader? Kim Jong Il it appears that many of the countries elite officials are considering defecting the country during it?s moment of mourning.

Speaking to the?Korea Times?Do Hee-yun, secretary general of a group that works with North Korean refugees revealed:

?Many ranking North Korean officials in China are refusing to return after being summoned to North Korea.?

News of possible defections began to circulate after Pyongyang began calling senior officials back to the country during their recent China trip. According to the reports the leaders were called back before news of Kim Jong Il?s death was circulated around the country.

Do reports that many of the leaders have used stalling tactics to avoid a return to their homeland, claiming that they are still waiting to collect much needed payments for the country among various other excuses.

It?s believed that the leaders realize the countries reluctance to take strong action during the mourning period, which in turn has given them time to weigh their options.

The biggest reason for not wanting to return according to?Seoul?s Sejong Institute is the fact that the new leadership may decided to purge certain top ranking officials who worked for years under Kim Jong Il.

At this time news of the defections has not been confirmed by South Korean officials who would be most likely to receive the political refugees should they choose to leave their country.

Is Your Bank Small Business Friendly?

When it comes to getting a small business loan, does it matter whether the bank you borrow from is a small bank or a large bank? The New York Times reports that larger banks are making fewer SBA-backed loans to small business, leaving the market open to smaller community banks. But do smaller banks do more for small business?

Ami Kassar, CEO of?MultiFunding LLC,?thinks they do. In an article on?Huffington Post, Kassar was quoted as saying:

?I?d rather deposit my money into a bank that is more likely to take that money and lend it out to other small businesses that need it than to a large multinational bureaucracy that is far less likely to make loans to small businesses that help the economy.?

But do community banks really contribute that much more to their local economies than larger banks with dozens of branches in a single city??Chase, for one, provides grants and investments in communities?each year. So does?Bank of America. And with deeper pockets than any regional bank could ever have, is it fair to criticize larger banks for not understanding small businesses simply because they?re not small themselves?

MultiFunding, which advises small businesses on the best loan for their situations,?recently came out with a bank lending grader tool. ?Using the tool, you can find out?how small-business friendly different banks are. ?The tool rates 6,800 banks in the United States. The tool calculates the rating based on?quarterly FDIC call reports, as well as the total small-business loan balance for each bank divided by its total domestic deposits.

It assigns each bank a grade (A, B, C, D or F). ?Most banks (82.5%) get a grade of A or B, meaning that they use at least 10% or more of their deposits to make small business loans. ?About 1187 of the banks use less than 10% of their deposits to make small business loans ? they got ratings from C through F. Figures are based on data as of June 30, 2011. ?Kassar says:

?The tool will help small business owners find banks in their areas that are most likely to make small business loans.? This way they don?t have to waste time at banks that say they?re lending ? but aren?t doing their fair share.?

MultiFunding?s tool does not give insight into how much a bank gives back to a particular local community.

How Should You Rate A Bank Lender?

MultiFunding?s tool is a place to start. ?The information is valuable and takes only a minute to look up.

But Rohit Arora, CEO of Biz2Credit, says there are other ways to judge a bank when looking for a small business loan. He notes these key questions you should ask when you?re considering a loan:

  • What is the bank?s underwriting criteria? (credit scores, number of years in business, etc.)
  • What industries does it fund?
  • What age of business does it want?
  • Does the bank make SBA loans or is it a non-SBA lender?
  • Will the bank fund startup loans?

The key is to do your homework. Look at a variety of resources out there. The SBA website gives you a checklist?to determine what sort of loans or financing you qualify for. If you want assistance finding a loan, consider working with a company like MultiFunding, Biz2Credit or Intuit Loan Finder?to work with a loan expert. ?And there?s plenty of content online, such as what?s found on Paychex?s brand new Build My Biz?site.

Hay Fever Symptoms Worse in Spring Than Summer: Study (HealthDay)

FRIDAY, Dec. 23 (HealthDay News) -- Hay fever symptoms -- itchy, watery eyes, sneezing and runny nose -- are worse in the spring than summer even when pollen counts are the same, according to a new report.

In the study, researchers compared daily pollen counts during the 2007 and 2008 hay fever seasons with daily symptoms reported by hay fever sufferers living around Leiden in the Netherlands.

The study participants were also tested for other common allergies, including birch pollen, house dust mites, dogs and cats.

The investigators found that hay fever symptoms matched the concentration of pollen in the air and also the amount of medication taken by the participants. They took more medication on days with high pollen counts and severe hay fever symptoms and less medication on days with low pollen counts and milder hay fever symptoms.

But hay fever symptoms were reportedly worse during the spring than summer for a similar pollen count, according to the study published online Dec. 21 in the journal Clinical and Translational Allergy. This finding could not be explained by medication use or other allergies.

"It is possible that sufferers report their symptoms as milder later in the season because they get used to their hay fever, or that the pollen from late-flowering species is less allergenic than pollen from early-flowering grass," study leader Dr. Letty de Weger, of Leiden University Medical Center, said in a journal news release.

"However, there has been other work which suggests that high exposure to grass pollen early in the season may down-regulate inflammation on subsequent contact possibly via the production of allergen-specific regulatory T cells," de Weger added.

?What I would like students to come in knowing what they want to do for a living,? says David Weatherhead coordinator and instructor in the Automotive Service Technician Apprenticeship Canadian Tire MAP 32 at Centennial College. ?If they know that they want to be automotive service technicians and they want to work for a Canadian company that?s progressive and has lots of business and opportunities across the country, that?s about the best things they can do. Ideally, I?d like them to be working with a Canadian Tire store. However, that?s not a necessity.? In addition, students applying to this undertaking must present at minimum an Ontario Secondary School Diploma or GED or equivalent. For this automotive service technician apprenticeship, candidates may apply directly to Centennial College. As space in the program is limited, acceptance is based on successful completion of all entry requirements. Successful applicants must obtain an employer and then register as a MAP apprentice with the Apprenticeship Branch of the Ministry of Training, Colleges and Universities.

Meanwhile, the four offered weeks of on the job training gives students the opportunity to face real life scenarios, apply what they have learned, network and gain insight into the industry from seasoned professionals.

Canadian Tire offers customers a large selection of national and retail brands through three specialty categories in which the organization is the market leader ? automotive parts, accessories and service; sports and leisure products; and home products. 2012 CES will be our last show: Microsoft

New York: Microsoft Corp. is pulling out of the International Consumer Electronics Show, the largest trade show in the Americas. It's joining Apple in saying that it prefers to put on its own events when the time is right to show off its products.

Microsoft said the next show, to be held January 9-12 in Las Vegas, will be the last show at which it has a booth or the CEO delivers the customary kick-off speech.

Company founder Bill Gates delivered keynote speeches at the show for 11 straight years. Current CEO Steve Ballmer has delivered the speech for the past three shows and will present his last next month.

It prefers to put on its own events when the time is right to show off its products.

Microsoft says 2012 CES tech show will be its last

The software company has been one of the biggest US supporters of the annual event, which gathered nearly 150,000 people this year. Originally focused on living-room electronics, the show has become the big annual US event for all consumer technology after the demise of big computer-focused shows such as Comdex.

Microsoft says it will continue to use CES as a place to connect to customers, but it won't have a booth because its product milestones don't align with the show's January timing.

At the upcoming show, Ballmer is scheduled to speak about the Windows 8 operating system. But the software isn't expected to be ready until late next year, so computer makers won't have any real Windows 8 products at the show.

"They're not cooked yet. So he's going to be stuck trying to present a bunch of stuff that will be months away from being ready," said technology industry analyst Rob Enderle.

Apple doesn't participate in trade shows at all after pulling out of the Macworld Conference & Expo after 2009.

The Consumer Electronics Association, which organizes CES, said it has tremendous demand for invitations to hold keynote speeches, and it has already received feelers from companies that want to rent for the 2013 show the space where Microsoft usually has its booth.

Japan's exports fall for second straight month (AP)

TOKYO ? Japan's exports fell for the second straight month in November, hit by faltering demand from Asia and Europe.

Exports shrank 4.5 percent from a year earlier to 5.198 trillion yen ($66.7 billion), according to a finance ministry report released Wednesday. The result is steeper than October's 3.8 percent decline.

The data underscore the growing pressures facing the world's third-largest economy, which relies heavily on exports to drive growth. A persistently strong yen, Europe's debt problems and the recent flooding in Thailand are eroding gains made since the March earthquake in Japan disrupted manufacturing.

Economists predict economic growth will slow this quarter after the economy expanded at an annualized rate of 5.6 percent in the July-September period.

Shipments to Asia ? usually a source of robust demand ? fell 8 percent in November. Exports to the European Union and the Middle East also retreated, while those to North America rose slightly.

Goldman Sachs economist Chiwoong Lee described the falloff in shipments to Europe as "especially pronounced."

"This suggests that the deterioration in financial conditions in Europe may be having a negative impact on demand there," he said in a research note.

By sector, electrical machinery exports took a 10.7 percent hit as demand for semiconductors and audio equipment tumbled. Motor vehicles shipments slipped 0.6 percent from a year earlier.

Meanwhile, imports jumped 11.4 percent to 5.882 trillion yen as Japan bought more fossil fuels to meet electricity demand.

That resulted in a November trade deficit of 684.7 billion yen. It was the second straight monthly deficit.

The turmoil in Europe and the U.S. has driven up the yen as global investors flock to the currency as a relatively safe haven. The yen hit multiple historic highs against the dollar this year.

A rising yen shrinks the value of overseas earnings when repatriated and makes Japanese products less competitive in overseas markets. The yen has weakened to around 78 to the dollar recently, but exporters say it is still too high.

The currency levels have forced manufacturers including Nissan Motor Co. and Panasonic Corp. to shift some production overseas, a trend that could further undermine Japan's exports.

Before Lake Huron, there were hunters

An ancient piece of wood found at the bottom of Lake Huron hints at a time, about 8,900 years ago, when this area was dry land where ancient hunters may have lived.?

The piece of wood measures about 5-feet, 6-inches (1.7 meters) and seems to have been a tool of some kind.

"The first thing you notice is that it appears to have been shaped with a rounded base and a pointed tip," said John O'Shea, an anthropologist at the University of Michigan, Ann Arbor. "There's also a bevel on one side that looks unnatural, like it had to have been created. It looks like it might have been used as a tent pole or a pole to hang meat."

A more-detailed analysis is under way to determine if this is indeed the case. Using carbon dating ?which looks at a radioactive form of carbon in a sample to determine its age ? the wood was estimated to be about 8,900 years old.

O'Shea and colleague Guy Meadows, also of the University of Michigan, previously found evidence of lanes used by ancient hunters to drive caribou to slaughter on Alpena-Amberley Ridge, similarly now underwater. During ancient periods when water was low, this ridge formed a land connection linking northern Michigan with central Ontario.

"One of the enduring questions is the way the land went underwater. Many people think it must have been a violent event, but finding this large wood object just sitting on the bottom wedged between a few boulders suggests that the inundation happened quickly but rather gently. And this in turn suggests that we'll find more intact evidence of human activity in the area," O'Shea said.

The researchers spotted the mysterious piece of wood about 100 feet (30.5 meters) below the lake's surface using the camera of a remotely operated aquatic vehicle.

They also collected other articles from the bottom of the lake, which are now being analyzed.

Padres net a huge haul

The Padres weren?t looking to trade their 24-year-old ace, but there?s simply no way that they could turn this down.

Cincinnati sent 1B/OF Yonder Alonso, C Yasmani Grandal, RHP Edinson Volquez and RHP Brad Boxberger to San Diego for RHP Mat Latos in a trade announced Saturday.

In return, the Reds get one of the game?s most promising young pitchers to head a rotation also set to include Johnny Cueto, Bronson Arroyo, Homer Bailey and either Mike Leake, Aroldis Chapman or Travis Wood. Latos is 27-29 with a 3.37 ERA in 2 1/3 innings since debuting with the Padres in 2009. He?ll make close to the minimum next year and he?s four years away from free agency, making him a very valuable property.

Still, this looks like a pretty classic overpay from a frustrated GM in Walt Jocketty. The Reds? plans had been stifled all winter to date. Now Jocketty has resorted to using the Reds? two-best trade chips, their still tantalizing reclamation project and one of the game?s best relief prospects, all in the same deal.

Alonso, the seventh overall selection in the 2008 draft, excelled in his time?in the majors last season, batting .330/.398/.545 in 88 at-bats. His minor league numbers were more good than great, so he?s probably not a future All-Star. However, he projects as a nice regular at first base and the Padres will have him under control for six years. What that means for fellow top prospect Anthony Rizzo still has to be figured out. Alonso could be stashed in left field at some point or maybe he gets traded again. For now, he?ll probably start at first, with Rizzo returning to Triple-A.

Grandal, the 12th overall pick in the 2010 draft, is one of the game?s top five catching prospects, but he was blocked by an even better one in Cincinnati in Devin Mesoraco. He hit .296/.410/.510 in 206 at-bats in high-A and .301/.360/.474 in 156 at-bats in Double-A last season. He also projects as an above average defender. He?s going to need a year in Triple-A, but his arrival makes Nick Hundley expendable in San Diego.

Volquez, 28, went 17-6 with a 3.21 ERA for the Reds in 2008 before undergoing Tommy John surgery in 2009 and getting hit with a 50-game PED suspension during his rehab. Things seemed fine after he returned in 2010, but he struggled mightily last season, going 5-7 with a 5.71 ERA and 65 walks in 108 2/3 innings. Volquez still has his old velocity, so the upside is there if he can start throwing more strikes. He?ll make about $1.8 million next year and he?s under control through 2013, so he still qualifies as a pretty nice pickup.

Boxberger is the lesser name in the deal, but he was looking like a potential closer of the future for the Reds. The 2009 supplemental first-round pick had a 2.03 ERA and a 93/28 K/BB ratio in 62 inings between Double- and Triple-A last season. Boxberger throws 92-95 mph and has a surprisingly good changeup to go along with his slider. He could win a spot in the Padres bullpen next spring and become one of the team?s top relievers quickly.

So, the Reds got their impact player, and that counts for something in an NL Central that?s looking pretty winnable with Albert Pujols and Prince Fielder departing. Latos is no Petco creation ? he has a lifetime ERA of 3.57 on the road ? and he still has the potential to take his game up a notch. It?s just that the cost was huge, and while the Reds didn?t give up anyone they looked at as a key player for 2011, they certainly hindered their ability to make future trades by giving up four quality properties here. Score one for the Padres. When teams say they?re not going to trade a player unless their bowled over, this is precisely the kind of deal they have in the back of their minds.

Report: Wide abuse in Dutch Catholic institutions

(AP) ? Thousands of children suffered sexual abuse in Dutch Catholic institutions, and church officials failed to adequately address the abuse or help the victims, according to a long-awaited investigation released Friday.

The report by the an independent commission said Catholic officials failed to tackle the widespread abuse "to prevent scandals." The suspected number of abuse victims who spent some of their youth in church institutions likely lies somewhere between 10,000 and 20,000, according to a summary of the report.

Based on a survey among more than 34,000 people, the commission estimated that one in 10 Dutch children suffered some form of abuse. The number doubled to 20 percent of children who spent part of their youth in an institution ? whether Catholic or not.

The commission said it received some 1,800 complaints of abuse at Catholic schools, seminaries and orphanages and that the institutions suffered from "a failure of oversight." It then conducted the broader survey of the general population for a more comprehensive analysis of the scale and nature of sexual abuse of minors.

The commission was set up last year under the leadership of former government minister Wim Deetman to investigate allegations of abuse dating from 1945.

Deetman said that the problem of abuse continued in part because the Catholic church organization in the Netherlands was splintered, so bishops and religious orders sometimes worked autonomously to deal with abuse and "did not hang out their dirty laundry."

However, he said that the commission concluded that "it is wrong to talk of a culture of silence" by the church as a whole.

The Dutch Bishops Conference scheduled a press conference for Friday afternoon to respond to the report.

The investigation followed allegations of repeated incidents of abuse at one cloister that quickly spread to claims from Catholic institutions across the country, echoing similar scandals around the world.

The commission identified about 800 priests, brothers, pastors or lay people working for the church who had been named in the complaints. About 105 of them were still alive, although it was not known if they remained in church positions, the report said. It identified them as "perpetrators" rather than "offenders," meaning they had not been proven to have committed a crime.

The Dutch branch of the Catholic church agreed last month to launch a compensation system that clears the way for victims of abuse by priests and other church workers to receive payments.

The new compensation system has a scale starting at euro5,000 ($6,500) and rising to a maximum of euro100,000 ($130,000) depending on the nature of the abuse.

According to the Dutch Central Bureau for Statistics, 29 percent of the Dutch population of 16 million identified themselves as Catholics in 2008, making it the largest religion in the country.

Judge to consider challenge of Utah bigamy law (AP)

SALT LAKE CITY ? A polygamous family made famous on a reality television show is asking a Utah federal judge not to block their challenge of the state's bigamy law.

Kody Brown and wives Meri, Janelle, Christine and Robyn filed a lawsuit in Salt Lake City's U.S. District Court in July. Oral arguments in the case are set for Friday before U.S. District Judge Clark Waddoups.

The stars of the TLC show "Sister Wives" said the law is unconstitutional because it prohibits them from living together and criminalizes their private sexual relationships.

Under Utah law, people are guilty of bigamy if they have multiple marriage licenses, or if they cohabitate with another consenting adult in a marriage-like relationship.

Formerly of Lehi, the Browns and their 17 children moved to Nevada in January after police launched a bigamy investigation. The Browns practice as part of their religious beliefs.

Oral arguments in the case are set for Friday in Salt Lake City's U.S. District Court.

It's not clear when Waddoups will rule.

State prosecutors contend the Browns ? who haven't been charged ? aren't facing any real harm because the state has rarely prosecuted individuals for bigamy without also prosecuting for other crimes, such as underage marriages, sexual abuse or welfare fraud.

"They have not been warned that if they do not cease to engage in their polygamous relationships that legal actions will be taken against them," Assistant Utah Attorney General Jerrold S. Jensen has said in court papers asking the judge to dismiss the case.

"And ? what is probably the tipping point ? there have been no arrests or prosecutions for the mere practice of polygamy in Utah in over 50 years."

A check of state court records by The Associated Press found at least two cases, however.

Bob Foster had three wives when he was arrested and charged with bigamy in 1974. He pleaded no contest and was sentenced to six months in Jail. He was released after 21 days and ordered to serve five years of probation. A judge also said Foster was not allowed to live with his families. Foster died from cancer in 2008. He was still married to all three women.

Mark Easterday was arrested and charged with bigamy in 1999. Authorities were alerted to Easterday's multiple marriage by his first wife as part of a custody battle during their divorce. He ultimately pleaded no contest to adultery because the divorce was finalized before the bigamy case went to trial. Easterday was sentenced to probation.

Easterday, who left Utah and is currently married to two women, told The Associated Press he believes the Browns are right to fear a bigamy prosecution.

"I know from experience that they do prosecute," Easterday said. I think they should change the law over the entire country. Why it is that in some places a woman and a woman can be married, but a man can't have another wife?"

Polygamy in Utah and across much of the Intermountain West is a legacy of 19th century Church of Jesus Christ of Latter-day Saints. Mormons abandoned the practice of plural marriage in the 1890s as a condition of Utah's statehood. The church now excommunicates members found engaging in polygamy.

An estimated 38,000 self-described Mormon fundamentalists continue the practice, believing it brings exaltation in heaven. Most keep their way of life a secret. In most cases, polygamous men are legally married to their first wives and marry subsequent brides only religious ceremonies.

(AP) ? The fallout from the death of a Florida A&M University drum major broadened Wednesday to nearly two dozen high schools in Georgia, where marching band activities were suspended over concerns of "inappropriate physical activity" between band mates.

A metro Atlanta school district began investigating after Robert Champion died Nov. 19. The Southwest DeKalb High graduate was found unresponsive on a bus parked in front of an Orlando hotel after a university football game, and authorities said his death involved hazing.

Another Florida A&M student, Bria Shante Hunter, who also attended Southwest DeKalb, told police she was severely beaten in a hazing ritual about three weeks before Champion's death.

Hunter, a freshman and clarinet player, said she was repeatedly hit in her legs by members of the "Red Dawg Order," a band club for Georgia natives. Authorities have said Champion was hazed, but have not described how.

Three band members were arrested in Hunter's case and charged with hazing. Two were also charged with battery.

Meanwhile, Florida authorities looking into Champion's death opened a new investigation after they uncovered possible employee fraud and misconduct at the university, according to documents released Wednesday.

The separate investigation was triggered by information investigators discovered regarding the finances of the Marching 100, according to a person in Gov. Rick Scott's administration. He asked for anonymity because he was not publicly authorized to discuss the matter.

In Georgia, Walter Woods, spokesman for the DeKalb County school district, said they were investigating marching bands at the district's 21 high schools after two problems over the summer. He declined to say whether the incidences involved hazing and said the students involved were not injured.

"Our interest is in protecting students, the safety of the students," said Woods. "We have notified schools to be vigilant of our existing policy, which is zero tolerance for harassment of any kind."

The bands' busy season ended last week with the conclusion of football season, but the Atlanta-area bands will still be able to perform in the Martin Luther King Day parade in Stone Mountain in January, Woods said. No marching bands are scheduled to perform in a football bowl game.

Decatur resident Keith Sailor, who is the president of the marching band booster club at Southwest DeKalb High School, said his son, a sophomore, has never had any problems with hazing.

"I'm pretty comfortable with him participating in the band," he said, declining further comment.

Experts say hazing has been found in students as young as 12, particularly when it involves a team activity like sports or band. Richard Sigal, a retired New Jersey sociology professor and expert on hazing, said schools need to examine whether it is happening.

"I think anytime you get a group of young people together, at some point, a tradition becomes established and that's what perpetuates hazing," Sigal said. "It's up to coaches, it's up to the principals, it's up to the band leaders to stop it."

In Florida, the state law enforcement agency sent letters to the head of the FAMU board and the head of the state university system, but they did not detail the potential fraud or misconduct, saying only that it involves school employees as well as "persons associated" with the university.

The school's president, James Ammons was hired more than four years ago as part of an effort to clear up past problems at the university. State audits found that some financial records could not be verified and there was questionable contracting. The college also could not account for millions of dollars in inventory.

Last week, the school's board of trustees publicly reprimanded Ammons after a contentious debate on whether he should have been placed on leave.

Solomon Badger, chairman of the FAMU board, said the university would cooperate with the new investigation.

"I didn't know anything about the fraud and I still don't," Badger said.

University officials have suspended the famed Marching 100 band from performances until the investigation into Champion's death is completed.

AAA: U.S. holiday travel to rise at year-end

Family ties will trump economic worries this holiday season as more Americans take to the road for the Christmas and New Year break, travel group AAA said on Wednesday.

Just under 92 million Americans are expected to drive or fly 50 miles (80 km) or more from home between Dec. 23, 2011 and Jan. 2, 2012, AAA said.

That would represent a 1.4 percent increase over the numbers that traveled a year earlier and the second-highest year-end exodus in a decade, the group said.

Some 93.7 million people traveled for the year-end holiday in 2006, AAA data shows.

About 91 percent of holiday travelers are expected to drive to their destination, a 2.1 percent increase year-on-year.

AAA said a gallon of gasoline sells for $3.27 at present, about 29 cents more than a year ago.

The forecast, based on a monthly survey of 50,000 homes, said about 5.4 million -- down 10 percent year-on-year -- would fly over the holiday season.

State: Mom who shot kids, self denied food stamps (AP)

SAN ANTONIO ? A Texas woman who for months was unable to qualify for food stamps pulled a gun in a state welfare office and staged a seven-hour standoff with police that ended with her shooting her two children before killing herself, officials said Tuesday.

The children, a 10-year-old boy and a 12-year-old girl, remained in critical condition Tuesday. The shooting took place at a Texas Department of Health and Human Services building in Laredo, where police said about 25 people were inside at the time.

Authorities identified the mother as Rachelle Grimmer, 38, and children Ramie and Timothy. Laredo police investigator Joe Baeza said Grimmer had recently moved to the border city from Zanesville, Ohio, about 30 miles east of Columbus.

Grimmer first applied for food stamps in July but was denied because she didn't turn in enough information, Texas Department of Health and Human Services spokeswoman Stephanie Goodman said.

Goodman said it wasn't immediately clear what information the mother was missing.

"We were still waiting, and if we had that, I don't know if she would still qualify or not," Goodman said.

Goodman said the Grimmer's last contact with the agency appeared to a phone call in mid-November. When the family entered the Laredo office on Monday shortly before 5 p.m., Goodman said Grimmer asked to speak to a new caseworker, and not the one whom she worked with previously.

Shortly thereafter, Goodman said, Grimmer was taken to a private room to discuss her case. She said it was there the mother revealed a gun and the standoff began.

Police negotiators stayed on the phone with Grimmer throughout the evening, but she kept hanging up, Baeza said. She allegedly told negotiators about a litany of complaints against state and federal government agencies.

Despite those complaints, Baeza said it wasn't clear what specifically triggered the standoff.

"This wasn't like a knee-jerk reaction," said Baeza, adding that Grimmer felt she was owed restitution of some sort.

She let a supervisor go unharmed around 7:45, but stayed inside the office with her children. After hanging up the phone around 11:45, police heard three shots, and a SWAT team entered the building. Inside, they found Grimmer's body and her two wounded children.

The children were "very critical" and unconscious when taken from the scene, Baeza said.

Goodman credited an office supervisor, a 24-year veteran of the agency, for ensuring the release of the other employees.

"He had told her he would try to help her, and that if she would let everyone else leave, he would talk to her," Goodman said.

Goodman didn't know whether Grimmer had a job, or whether her children were covered under Medicaid or the state children's health insurance program. The family had no history with the Texas Department of Child Protective Services.

The family's move from Ohio may have complicated Grimmer's application if the family had no Texas records the agency could check electronically, Goodman said. Grimmer would have also been denied benefits if she was receiving welfare assistance.

Goodman said the agency would try to answer why Grimmer, after having been denied food stamps in early August, waited until mid-November to call back and check on her case.

"The indications she had she was dealing with a lot of issues," Goodman said.

State welfare offices have come under scrutiny in the past for being overburdened, but Goodman said the agency has made significant strides in the past three years. She said wait times are shorter, and that Grimmer was scheduled for her initial interview just one day after applying. Grimmer didn't make the appointment, she said.

Goodman said it's not unusual for caseworkers to confront angry or confused benefit-seekers, but that it's very rare for a situation to escalate to violence.
