Sony Xperia SP on sale now in the UK at T-Mobile, Orange and EE

Sony's mash-up Xperia, the SP, is taking its transparent element light show to the UK today, giving budget-minded Brits one stylish and feature-packed mobile alternative. The 4.6-inch 720p handset, which is basically a Best of... edition of the Xperia S and P with an aluminum unibody, is shipping now at T-Mobile UK for £250 outright (about $387 USD), whereas Orange and EE are offering up the device for free with qualifying plans. If you want LTE, however, you only have one carrier option and that's EE -- a choice that'll have you shackled for a two-year period. As for O2 and Three, those carriers still have the SP listed as "coming soon," but it's safe to say you won't find a better bargain than *free.

*Nothing in life is free.

The Golden Truth: Is Your Gold Missing?

When it becomes widely known that all of the people who think they own gold in fact don?t own gold, that it?s been hypothecated and re-hypothecated so many times that there are 100 claims for every single ounce of physical gold, that is when the prices of gold and silver will really go berserk to the upside, and at that point the shorts will have serious problems? - John Embry on King World News
?The press pounced all over the massive smack down on gold/silver last week.? Headlines were thrust in everyone's face.? Gold dropped? $200 dollars in two days and the media wanted to make sure everyone knew about it.? Well, guess what?? As I write this, gold has gained back over $100 that drop. But is this being broadcast in flashing marquee lights the way the sell-off was?? Of course not.

In the aftermath of that sell down, a lot of facts have come to light.? But first, the bounce we're seeing is illustrative of the fact that you need to hold on tight in this sector in order to truly benefit from the wealth benefits of investing in physical gold/silver and good mining stocks.? As an example, since late 1999, the mining stocks have suffered two periods in which the mining stocks had severe sell-offs of this magnitude - late 1999 to early 2001 and mid-2008 - Oct 2008 - in response to large manipulated drops in the metals.? But after the sell-off ended, it literally took less than 3 months for the HUI/XAU indexes to double from their bottom and then head to new all-time highs a few years after that.? I feel bad for anyone who was shaken out this time around, but I guarantee you that Wall Street does not harbor the same sympathies...

At any rate, what's been exposed from this market price correction is the fact that 1) more people now understand why it is important to own physical gold and silver, as evidenced by the fact that the U.S. mint quickly sold out of silver eagles and is on a track to sell a record monthly amount of gold eagles; and 2)? there is a serious problem globally with the amount of gold that is available for physical delivery to the buyers who are demanding actual delivery.

I thought I would go over some statistics from the Comex to illustrate why we know this is the case.? The total gold held on the Comex is 8.5mm ozs, of which 6.3mm is not available for delivery - i.e. it's investor gold being held in Comex vaults.? Stunningly, over 2 million ounces of gold -? roughly 60 tonnes - has been removed from the Comex vaults in the last three months.? Most of it has come from investor accounts.? You have to wonder why all of a sudden big investors have removed their gold from the Comex.

Investor gold is not "eligible" for delivery on futures contracts.? The gold that can be delivered is sitting in "registered"accounts. The amount of registered gold currently is 2.28 million ozs.? The total open interest in futures contracts for gold is 416k contracts, or contracts representing 41.6 million ozs.? Essentially there's 18x more paper gold in the form of futures open interest than there is gold that can be delivered.? The June front month for gold has 255k open contracts, or 25.5mm ozs open.? That's 11x the amount of gold available for delivery.? If even 10% of June gold contract longs held for delivery, the Comex would be completely wiped out of its gold and would have to default on the delivery of some.? But the Comex has a "force majeur" clause in its contract that allows cash settlement.? We won't see that happen in the near future most likely, but it will eventually happen.

In silver the total open interest represents 786.3 million ozs.? That's about 3/4 of global annual production, which includes 257mm ozs of recycled silver.? So, the total open interest on the Comex is about equal the total annual amount of silver mined globally.? There's 39mm ozs of silver available for delivery.? In other words the amount of paper silver on the Comex is 20x the amount of silver the Comex has for delivery.

I think that explains why big investors are removing their gold from the Comex.? The Comex is one giant Ponzi scheme.? Anyone who is going to rely on the Comex as a source of silver, either industrial or investment, is going to be left holding a giant, empty paper bag.? That explains why we are seeing a such frenetic activity - not just in this country but globally - by investors looking to get their hands on gold/silver that can be physically delivered into their possession.? A long-time colleague of mine prepared this caption, which sums up the situation perfectly:


As the severity of the physical gold/silver shortage vs. the paper claims issued (futures, LBMA forwards, OTC derivatives and Central Bank leases and swaps) against that actual amount physically available - as demonstrated by my Comex example, which is only part of the global problem - the price of gold and silver is going to start to go parabolic.? Although most of you are not aware, but from 1974-1976, the price of gold dropped 47%.? But from 1976 to 1980 the price of gold went up 800%.? Given what we know about the massive, unsolvable global financial problems, and the enormous amount of money that will have to be printed to keep the system from collapsing outright, it's a good bet the next extended move in the metals will dwarf the move gold made in the late 1970's.

Second Mississippi man investigated in ricin case

TUPELO, Miss. (AP) ? A second Mississippi man investigated in connection to ricin-laced letters sent to the president and a U.S. senator said Wednesday that investigators "ripped" through his house during an hours-long search the previous day after charges were dropped against another man in the case.

No investigators appeared to be at the Tupelo home Wednesday morning, and Everett Dutschke said he'd gone to a friend's house to rest. Piles of items could be seen all over the floor through the window. The home was searched Tuesday by dozens of officials, some in hazmat suits, from early in the afternoon until about 11 p.m. CDT. Officials declined to comment on what they had found or on the next phase of the investigation.

At one point, two FBI agents and two members of the state's chemical response team left Dutschke's property and began combing through ditches, culverts and woods about a block away from his house in the neighborhood of single-family detached homes.

Dutschke (DUHST'-kee), who spoke with The Associated Press by telephone during the search, said his house was also searched last week. He said he and his wife had gone to a friend's Wednesday because they didn't feel safe at their home.

"They ripped everything out of the house," he said Wednesday morning, adding: "I haven't slept at all."

On Wednesday, dozens of investigators were searching at a small retail space where neighboring business owners said Dutschke used to operate a martial arts studio. Officers in hazardous materials suits were seen going in and out of the building. No officers at the scene would comment on what they were doing.

No charges have been filed against Dutschke and he hasn't been arrested. Both he and Paul Kevin Curtis, who had faced charges in the case, say they have no idea how to make the poisonous ricin and had nothing to do with sending the letters to President Barack Obama, U.S. Sen. Roger Wicker of Mississippi and Mississippi county judge Sadie Holland.

Curtis, a 45-year-old celebrity impersonator, has maintained his innocence since his arrest.

Referring to investigators' questions, Curtis said after he was released from custody Tuesday afternoon, "I thought they said rice and I said, 'I don't even eat rice.' ... I respect President Obama. I love my country and would never do anything to pose a threat to him or any other U.S. official."

A one-sentence document filed by federal prosecutors said charges against Curtis were dropped, but left open the possibility they could be reinstated if authorities found more to prove their case. Prosecutors were not immediately available for comment, but the document said the ongoing investigation had revealed new information. It did not elaborate.

Dutschke and Judge Holland know each other: In 2007, he lost his Republican bid for a seat in the Mississippi House of Representatives to Holland's son, Democratic state Rep. Steve Holland, who was the incumbent.

Steve Holland previously said that during a political rally in the small town of Verona in 2007, Dutschke gave a speech disparaging the Holland family, including him, his mother and his wife.

Holland said his mother, who spoke just after Dutschke at the rally, called him back on the stage and said, "You're not going to disparage me. Now, you apologize to me."

Holland said Dutschke returned to the stage and at Judge Holland's instruction, got down on his knees and apologized, but Dutschke disputed that Tuesday.

"That's just Steve Holland being Steve Holland," he said, adding that he did not get down on his knees and apologize for anything. "He's a bit grandiose about the way he describes things."

Since Curtis' arrest at his Corinth, Miss., home on April 17, his attorneys have said their client didn't do it and suggested he was framed. An FBI agent testified in court this week that no evidence of ricin was found in searches of Curtis' home.

The dismissal is the latest twist in a case that has been strange from the beginning and rattled the country during the same week as the Boston Marathon bombing and a fertilizer plant explosion in West, Texas.

Dutschke and Curtis are no strangers to each other. Dutschke said the two had a disagreement and the last contact they had was in 2010. Dutschke said he threatened to sue Curtis for saying he was a member of Mensa, a group for people with high IQs.

Hal Neilson, an attorney for Curtis, said the defense gave authorities a list of people who may have had a reason to hurt Curtis.

"Dutschke came up," he said. "They (prosecutors) took it and ran with it. I could not tell you if he's the man or he's not the man, but there was something there they wanted to look into."

An FBI intelligence bulletin obtained by the AP said the two ricin-laced letters addressed to Obama and Wicker said: "To see a wrong and not expose it, is to become a silent partner to its continuance." Both were signed, "I am KC and I approve this message."

Curtis was already well known to Wicker because he had written to the Republican senator and other officials. Curtis also wrote a novel called "Missing Pieces," about black-market body parts he claimed to have found while working at a hospital ? a claim the hospital says is untrue. Curtis posted similar language on his Facebook page and elsewhere. The documents indicate Curtis had been distrustful of the government for years. He told the AP on Tuesday that he realizes his writings made him an easy target.

Multiple online posts under the name Kevin Curtis on various websites that could be seen by anyone refer to the conspiracy he claimed to uncover when working at a local hospital from 1998 to 2000. In one post, Curtis said he sent letters to Wicker and other politicians. He signed off: "This is Kevin Curtis & I approve this message."

Christi McCoy, another attorney for Curtis, said she doesn't know what new information prosecutors have, but said the plot to frame her client was "very, very diabolical."

Curtis, dressed after his release Tuesday in a black suit, red shirt, necktie and sunglasses, said he met Dutschke in 2005 but that for some reason Dutschke "hated" and "stalked" him. "To this day I have no clue of why he hates me."

Ricin is derived from the castor plant that makes castor oil. There is no antidote and it is at its deadliest when inhaled. It can be aerosolized, released into the air and inhaled. The Homeland Security handbook says the amount of ricin that fits on the head of a pin is enough to kill an adult if properly prepared.

Dutschke said agents asked him about Curtis, whether Dutschke would take a lie-detector test and if he had ever bought castor beans, which can be used to make the potent poison.

"I'm a patriotic American. I don't have any grudges against anybody. I did not send the letters," Dutschke said.

After charges were dropped against Curtis, he said: "I'm a little shocked."

Tuesday's events began when the third day of a preliminary and detention hearing was canceled without officials explaining the change. Within two hours, Curtis had been released.

FBI Agent Brandon Grant said in court Monday that searches last week of Curtis' vehicle and house in Corinth, found no ricin, ingredients for the poison, or devices used to make it. A search of Curtis' computers found no evidence he researched making ricin. Authorities produced no other physical evidence at the hearings tying Curtis to the letters.

All the envelopes and stamps were self-adhesive, Grant said Monday, meaning they won't yield DNA evidence. One fingerprint was found on the letter sent to a Lee County judge, but the FBI doesn't know who it belongs to, Grant said.

The experience, Curtis said, has been a nightmare for his family. He has four children ? ages, 8, 16, 18 and 20. It also has made him reflect deeply on his life.

"I've become closer to God through all this, closer with my children and I've even had some strained relationships with some family and cousins and this has brought us closer as a family," he said.

PORTLAND, Maine ? The Finance Authority of Maine announced Tuesday that it has agreed to help finance the expansion of three Maine businesses, which will create or maintain 171 jobs.

According to an announcement from FAME, the organization?s board of directors last week approved the financing plans for the three companies which represent the transportation, tourism and manufacturing sectors.

Beth Bordowitz, CEO of FAME, described the financing efforts as a way to help kickstart business growth as the state begins climbing out of an economic recession that long stagnated the job market.

?We are beginning to see signs of an economic recovery taking hold in Maine and our actions

will help these businesses to position themselves to create and retain good Maine jobs,? Bordowitz said in a statement.

Benefiting from the authority?s latest actions are the Portland-based Custom Coach & Limousine, Mega Industries of Gorham and the Benton-based B&B Precise Products, Inc.

FAME directors approved a direct loan of $180,000 to Mega Industries, described in Tuesday?s announcement as a manufacturer of ?high-power, low-frequency microwave components for scientific, military and commercial applications.? The loan will allow the company to expand its Gorham plant, stabilize 46 jobs and add eight more positions.

The support for the other two Maine businesses will come in the form of loan insurance, which allows traditional lenders, such as banks, to extend a loan with less risk. In those cases, the lenders may not have been willing to lend money for a company to expand without assurances that the money will be repaid through an extra insurance claim if the business runs into trouble and cannot make its repayments.

With last week?s board vote, FAME will provide loan insurance for a number of Camden National Bank loans for Isherwood Enterprises Inc., which does business as Custom Coach & Limousine, effectively lowering the company?s debt and allowing it to maintain its staffing level at about 50 employees.

Similarly, the authority will insure three Androscoggin Bank loans to B&B Precise Products, which will use the money in part to acquire two new machines for its manufacturing facility, according to the FAME announcement. The expansion will allow B&B Precise Products to add between eight and 12 positions to its current 57-person workforce.

B&B Precise Products mills steel parts for clients such as Rolls Royce and defense contractor General Dynamics Corp., the parent company of Bath Iron Works and Armament & Technical Products in Saco.

?Our company very much appreciates FAME?s support,? said B&B President Wellman Rood in a statement. ?FAME?s actions will enable us to grow and compete in the global economy.?

The Open Frame Film Festival took place on April 20. The festival was held at the Canton Palace Theatre for?the second time,?although this was the first year it featured a red carpet event before the?film screening.

Dr. Andrew Rudd, associate professor of communication arts, began Open Frame 12 years ago after several of his students showed interest in making films. The event started with the films being shown on campus?in the Barn and has grown with each consecutive year. A film concentration for the communications major emerged from it.

The department is very supportive of students in their efforts to produce films for Open Frame.

?The real cost is the tools,? Rudd said. ?We allow any students who have taken our production classes to use the Malone equipment.?

Students can also apply for a grant up to $300. But the project is largely the responsibility of the students.

?My hope is that students will find their voice,? Rudd said. ?It?s very hard to do in videos. You also learn a lot of other practical skills when you?re making a film. You have to manage a schedule, manage a crew, and you have to have interpersonal skills, be able to communicate a vision in a compelling way, [and have] project management. Better than all of those is the ability to be a storyteller.?

While Malone provides much of the basic supplies students need, they are left on their own for any special supplies their film may require, recruiting actors, and covering the expenses of anything beyond what Malone can loan them. Several students choose to use the website Kickstarter?to raise support for their film.

?With Kickstarter, students put their idea up on the website and ask people to give them money,? Rudd said. ?If you meet your goal within 30 days, you get all the money that you raised.?

One student was able to raise $60,000 for his film on Kickstarter last year.

It was junior math major Kyle McClellan?s?first year directing a film for Open Frame.?McClellan used Kickstarter to help fund his film and to raise awareness and support. He still had to come up with some of the money himself, however.

?The lighting equipment cost a lot of money,? McClellan said. ?But one mom paid for the pizza for everyone. It maybe went $50 over budget besides the pizza and I just took that hit.?

Nate Merritt, a junior individualized major, directed a film for his second year.?He served as a production assistant?in a previous year. Merritt used Kickstarter last year and raised $500 with it but this year he funded his film completely out of pocket.

?It was a smaller film, it wasn?t as ambitious,? Merritt said. ?I didn?t think I needed as much money.?

Merritt has never had any real problems with producing his films or raising money for them. He has received a lot of support from family and friends for the projects. He also used people he knew as set workers and actors.

?Everyone?s work was an invaluable resource,? Merritt said. ?Surprisingly it wasn?t much of a challenge. I kind of had it easy.?

After the Open Frame Film Festival, students have many options of what to do with their film.

?One thing students can do with their film is put it in a drawer and never look at it again,? Rudd said. ?That?s a bad idea. One thing that a lot of students do is enter their films in other film festivals all around the nation.?

Students are also encouraged to develop a reel?or?put several clips from their films on a CD to show future employers. Many students also put their films on the internet, besides or in addition to entering them in other film festivals.

After Open Frame this year, Merritt plans to send his film to another?film festival. ?The original cut of this year?s video was 25 minutes long and it?s only allowed to be 15 minutes for the Open Frame,? he said. ?I?m going to submit the longer version to other festivals.?

?I definitely see myself doing this in the future and can?t see myself not doing it,? Merritt said.

He hopes to submit a film for Open Frame next year and to continue producing films in the future.

Low-dose aspirin stymies proliferation of two breast cancer lines

Apr. 21, 2013 ? Regular use of low-dose aspirin may prevent the progression of breast cancer, according to results of a study by researchers at the Veterans Affairs Medical Center in Kansas City, Mo., and the University of Kansas Medical Center.

The study found that aspirin slowed the growth of breast cancer cell lines in the lab and significantly reduced the growth of tumors in mice. The age-old headache remedy also exhibits the ability to prevent tumor cells from spreading.

The lead author of the study, Gargi Maity, a postdoctoral fellow who works in the cancer research unit at the VA Medical Center, will present the team's findings on Sunday, April 21, at the annual meeting of the American Society for Biochemistry and Molecular Biology, which is being held in conjunction with the Experimental Biology 2013 conference in Boston. The senior author is Sushanta Banerjee, director of the cancer research unit and a professor at the University of Kansas Medical Center in Kansas City, Kan.

The role of aspirin, or acetylsalicylic acid, in preventing and treating cancer has intrigued researchers since the late 1980s, when an Australian study found that people who regularly used aspirin were less likely to develop colorectal cancer. Aspirin use also has been shown to reduce the risk of squamous cell esophageal cancer and prostate cancer.

Anecdotal evidence indicated that breast cancer was less likely to return in women who took aspirin to lower their risk of heart attack or stroke. But the science behind this relationship is not well understood.

The VA study found that aspirin may interfere with cancer cells' ability to find an aggressive, more primordial state. In the mouse model the researchers used, cancer cells treated with aspirin formed no or only partial stem cells, which are believed to fuel the growth and spread of tumors.

Banerjee, a professor of medicine in division of hematology and oncology, says first-line chemotherapy treatments do not destroy stem cells. Eventually, the tumor will grow again. "If you don't target the stemness, it is known you will not get any effect," he says. "It will relapse."

In lab tests, aspirin blocked the proliferation of two different breast cancer lines. One of the lines tested is often called triple-negative breast cancer, a less common but more difficult treat form of the disease. "We are mainly interested in triple negative breast cancer, because the prognosis is very poor," Banerjee says.

Triple-negative breast cancers, which will be addressed in a special thematic program at the ASBMB annual meeting, lack receptors for estrogen, progesterone and Her2. Aspirin also may improve the effectiveness of current treatments for women whose breast cancers are hormone-receptor positive. In the team's study, aspirin enhanced the effect of tamoxifen, the usual drug therapy for hormone-receptor positive breast cancer.

Aspirin is used in the treatment of a number of different conditions. Banerjee says its ability to attack multiple metabolic pathways is what makes it potentially useful in the fight against cancer. "Cancer is not a single-gene disease," he says. "Multiple genes are involved."

Aspirin is a medicine with side effects, including gastrointestinal bleeding. Researchers will continue to explore if the positive effects of regular use of the drug outweigh the risks. In 2012, the National Cancer Institute asked scientists to design studies that would illuminate the mechanisms by which aspirin and drugs with other uses appear to reduce the risk of cancer or improve the prognosis for those diagnosed with the disease. Banerjee says his lab will apply for one of the grants.

Other co-authors at the cancer research unit include Snigdha Banerjee, associate professor of medicine in hematology and oncology at KU, and postdoctoral scholars Archana De and Amlan Das.

Predictably, Browns owner Jimmy Haslam denies wrongdoing by the company he runs, Pilot Flying J, in connection with customer discounts and rebates.? Even more predictably, the FBI and IRS wouldn?t have descended on company headquarters on Monday without evidence to support the allegations.

The evidence seems extensive, and much of it in the form of secretly recorded conversations.? Those conversations include an admission from a key employee of the company that Haslam was aware of the practice of shorting customers.

The 120-page affidavit was posted by the Cleveland Plain Dealer after being filed in court on Thursday.? We?ve read the entire thing.

The affidavit explains at paragraph 6 that a confidential informant contacted the FBI on or about May 4, 2011 to report that another employee of Pilot Flying J had confided ?that certain Pilot employees had been intentionally defrauding some of Pilot?s Customers by deliberately charging these Customers a higher price than the contractually agreed upon price, and then concealing the fact and nature of this increased price from these victimized customers.?

The informant recorded conversations with the other employee, who then agreed to cooperate in the investigation.? The second employee, after entering into a non-prosecution agreement, provided information about the fraudulent practices ? and began recording conversations with other Pilot Flying J employees.

The affidavit contains excerpts from numerous conversations and meetings.? For example, at paragraph 63 of the affidavit Pilot Flying J V.P. of Sales John Freeman had this to say during an October 25, 2012 Regional Directors meeting at Freeman?s lake house:? ??Hey this is a game.? We?re playin? f?kin? poker with funny money, and it?s liar?s poker with funny money because of all this cost-plus stuff.? So, you know, I?m not, I don?t want to get into a moral or ethical conversation, because I believe that if a guy?s gonna butt-f?k you then we got to go to butt-f?kin? him harder. . . . Some people are tits and some people ass guys and some people want their discount managed through the system and some people like a big check.? I mean, f?k, sell it to ?em the way they want to buy.? And understand, the f?ker?s got the ability to know what the hell you?re doing to ?em.? Okay??

Freeman said later in the meeting, ?F?k ?em early and f?k ?em often.?

Freeman referred repeatedly to having to ?buy an airplane? when Western Express, a trucking company, realized what was happening.? Specifically, instead of paying Western Express $1 million to rectify the situation, Pilot Flying J bought an airplane from Western Express that was on the books for $7 million, and on which Western Express owed $1 million.

At paragraph 81 of the affidavit, a recorded conversation contains an admission from Freeman that Haslam knew about the Western Express situation.? ?[H]e knew all along that I was cost-plussin? this guy,? Freeman said.? ?He knew it all along.? Loved it.? We were makin? $450,000 a month on him why wouldn?t he love it?. . .? Did it for five years, cost us a million bucks.? I mean, we made $6 million on the guy, cost us a million bucks.?

The recorded conversations potentially represent the tip of the evidentiary iceberg.? The affidavit was submitted to justify the search warrants that the FBI and IRS executed on Monday.? The company?s files and computers (including email chatter) possibly will contain many more references to the alleged scheme.

In the interim, Pilot Flying J should prepare to buy more planes.? While the company allegedly preyed on unsophisticated trucking companies by shorting them on discounts and rebates, those unsophisticated trucking companies are likely sophisticated enough to hire lawyers who will sue Pilot Flying J for a full refund, plus punitive damages.

Likewise, Pilot Flying J can now count on its competitors aggressively trying to convert customers by printing off the affidavit, highlighting some of the comments from Freeman, and asking those customers if they really want to continue doing business with a company like Pilot Flying J.

While these are only allegations and both the company and its employees are entitled to the presumption of innocence, the contents of the affidavit paint a picture that can get ugly for Haslam, in multiple ways.? As to the biggest question ? whether Haslam will face criminal liability ? the most important witness of them all could end up being John Freeman.

If Freeman flips and gives persuasive testimony against Haslam, Jimmy could be going down.

Comedy Central to launch Twitter comedy festival

NEW YORK (AP) ? Putting a new test to the adage that brevity is the soul of wit, Comedy Central is partnering with Twitter for a comedy festival played out in 140 characters and 6-second videos.

The Viacom Inc.-owned network said Sunday that the festival with the hashtag "ComedyFest" will debut April 29. Over five days, comedians will tweet jokes and post videos with the recently launched video app Vine, which limits footage to 6 seconds.

The launch of the festival, which Comedy Central is expected to officially announce Monday, was first reported by The New York Times.

Kicking off the social media festival will be an event Monday at the Paley Center in Los Angeles featuring Rob Reiner, Judd Apatow and Mel Brooks. So far, Brooks is a Twitter holdout.

The IPKat: Format as Pornography: As a Matter of Legal Definition ...

This Kat is a modest type. Rarely do his words evoke an analogy to pornography. But recently he found himself speaking at a local conference (with the main address having been given by a Justice of the Supreme Court) where such evocation was made. The topic of this Kat's address was IP (read: copyright) protection of formats in connection with movies, television programmes and the like. The issue that this Kat placed before the audience was simple: is it possible to come up with a definition of "format" that is applicable to the copyright law? After all, copyright law does not protect all forms of creative works, both only those works that fall under one of the statutory categories. If the so-called format cannot be robustly characterized in a manner that allows it to be reasonably categorized as a defined work under the copyright law, it would seem that seeking copyright protection is a non-starter. If that is so, then the question that follows is why enter into a licence agreement for use of a format if the legal subject matter does not yield a workable definition for copyright purposes. As such, a lot rides on the question of whether we can successfully define "format".

In that connection, this Kat first asked the audience to take several minutes, to pull out a pen or pencil, use a table napkin if need be, and propose a definition of "format". We then asked several members of the audience, including a professor of law, to each read out his or her proposed definition. Three such definitions were offered, with wide, even chasmic differences between them. While not promising, this Kat could attribute the diversity of definitions to the situation, with only a few minutes allotted to the task. Surely, when courts and commentators have the luxury of time and consultation, we can expect a much greater convergence in understanding. After all, some courts have ruled in favour of copyright protection in formats. This must mean that there is a relatively consistent understanding of the term. This Kat was, however, wrong.

Set forth are four examples of definitions or characterizations of "format".

1. "[T]he difficulty of the concept that a number of allegedly distinctive ?features of a television series can be isolated from the changing material presented in each separate performance (the acts of the performers in the talent show; the questions and answers in the quiz show, etc." (Green v. Broadcast Corporation of New Zealand, 1989)?RPC?(1989) 106 (22).

2. "The framework within which the central running characters will operate and which framework is intended to be repeated in each episode; the setting, theme, premise or general story line of the proposed serial or episodic series; and central running characters which are distinct and identifiable, including detailed characterizations and the interplay of such characters. It also may include one or more suggested story lines for individual episodes (Jessica E. Bergman, "No More Format Disputes: Are Reality Television Formats the Proper Subject of Federal Copyright Protection," The Journal of Business, Entrepreneurship & the Law (2011)) here.

3. "?[T]he framework of a reality show does not directly correspond to the framework of a scripted show. When identifying the protected elements of a scripted show, we look to 'plot, theme, dialogue, mood, setting, pace and sequence.' But a reality show does not employ these same elements, nor do these elements take the same form in a reality show as they do in a protected script ? leav[ing] the true expressive elements of a reality show unprotected" (J. Matthew Sharp, "The Reality of Reality Television: Understanding the Unique Nature of the Reality Genre in Copyright Infringement Cases," 8 Vanderbilt Journal of Entertainment and Technology Law (2005).

4. "Formats are compounds of creative, business and marketing elements. Some are dictated by external factors ? and some are generated by the internal logic of the show, such as its goals ? and its target audience. The value of a format derives to some extent from each individual element, but mostly from the combination of elements and the ability to create a symbiotic nexus between them" (Neta?li E. Gottlieb,"Free to Air? Legal Protection for TV Program Formats Chicago," John M Olin Law & Economics Working Paper no. 513 (2d series), 2010 here .

This Kat would like to believe that these definitions or characterizations are representative of the positions taken by courts and commentators. Assuming that this is true, then what seems to emerge are two things. First, it is difficult, bordering on the virtually impossible, to distill a single meaning based on these sources. Secondly, even if one can do so, it would appear to be extraordinarily challenging to wedge any such understanding within the notion of work (even if some courts across various jurisdictions have done so).

One retort is to remind this Kat that the notion of format covers a number of different types of creative endeavour. Three major categories come to mind: (i) game shows and other competitions; (ii) news and information programmes; (iii)ever-expanding forms of reality programming. Perhaps the way to overcome the daunting diversity in definitions is to provide a definition for each category. Even if this is practicable, however, the question still remains: why should any of these format types be appropriately understood as a "work" in the copyright sense? After all, in the 1980s, we witnessed the difficulty in fitting computer software within the notion of a literary work (the contents of even the most elegant source code lack much of a sense of plot or character) quickly led to extension of copyright protection for the "look and feel" of the programme. Within a few years, (most) courts saw the error in the judicial excess of their ways. Attempting to stretch copyright beyond its natural boundaries almost always leads to legal no good.

Which brings us back to pornography. One of the speakers at the conference sought to resolve the issue of definition of "format" by proposing an analogy to the well-known test for pornography offered by the U.S. Supreme Court Justice Potter Stewart in his concurrence in?Jacobellis v. Ohio, 378 U.S. 184 (1964)--"I know it [pornography or format] when I see it." (Full disclosure--while the movie theatre at issue was located in this Kat's former home town, he does not recall ever having frequented it.) This Kat cannot opine on how well this test has served U.S. jurisprudence. Whatever its applicability to pornography, it does not seem appropriate to apply it by analogy to the definition of "format" for copyright purposes. The question therefore remains?is copyright protection an appropriate means to protect formats?

Suspect alarmed relatives with extremist views

One of the Boston bombing suspects set off alarm bells among his family a year ago during a trip here to visit relatives, ABC News has learned.

According to a family member, Tamerlan Tsarnaev was kicked out of his uncle's house because of his increasingly extremist views.

Tamerlan Tsarnaev, 26, and his brother Dzhokhar, 19, are believed to have placed bombs at the Boston Marathon, killing three and wounding 170. Tamerlan was killed in a shootout with police early Friday and Dzhokhar was badly wounded and captured by police Friday night.

Tamerlan Tsarnaev spent roughly six months in Russia in 2012, but the relative, who insisted on anonymity to avoid offending other family members, insisted the young man had been radicalized in the United States before his trip.

Dagestan is one of the poorest and most violent regions of Russia, home to an Islamist insurgency that seeks to establish an independent state. So far, no links have tied him to militant groups here.

Members of Congress, however, say those six months last year were a turning point in Tamerlan Tsarnaev's radicalization.

"When he came back he starting posting more radical jihadist YouTube videos and started becoming more of a fundamentalist Muslim," Rep. Michael McCaul, chairman of the House Homeland Security Committee, told ABC News Friday.

"My concern is that he may have gone over there to visit his father and he received training and then became radicalized and then came back. Something happened in that period of time. He was not like that before," McCaul said.

The FBI, meanwhile, also looked into Tamerlan Tsarnaev in 2011.

In a statement Friday, the bureau said it investigated Tsarnaev on behalf of a foreign government, though it did not reveal which one.

"The request stated that it was based on information that he was a follower of radical Islam and a strong believer, and that he had changed drastically since 2010 as he prepared to leave the United States for travel to the country's region to join unspecified underground groups," the FBI statement said.

The bureau said that in response to the request it combed through its databases and interviewed the man and members of his family, but did not find any evidence he was tied to terror groups.

"The FBI did not find any terrorism activity, domestic or foreign, and those results were provided to the foreign government in the summer of 2011. The FBI requested but did not receive more specific or additional information from the foreign government," the FBI statement said.

The family member described Tsarnaev's father and mother as good parents who are distraught at the news. They tried to evade the media today after granting several interviews a day earlier, even instructing family members to tell reporters they had left for Chechnya. The pair were briefly spotted, however, by journalists waiting outside their home.

The relative said he saw them Friday and that the mother was sobbing and the father suffered some sort of panic attack in the evening. Also on Friday, according to a security source, the parents were questioned by security services.

The relative said Tsarnaev's father is a "traditional Muslim" who eschews extremism. He couldn't imagine his son would do such a thing, the family member said.

Alberta pharmacists are suggesting scrapping a marketing tool to protect patients from making unhealthy choices.

A proposal from the Alberta College of Pharmacists (ACP) suggests prohibiting pharmacies from offering inducements ? benefits like gifts, cash or loyalty points ? to people when they buy drugs.

?Inducement programs cause conflicts in the delivery of care,? said Kaye Moran, president of the ACP, in an online video explanation of the proposed prohibition.

?The prohibition is vital in creating practice environments where care decisions are made solely on the best health care, the highest ethical standards are observed and outside influences are removed from the relationships between patients and pharmacy professionals and between pharmacists and other health care providers.? Moran added.

The prohibition would apply to all prescription drugs as well as drugs that can only be bought through a pharmacy. According to the ACP, the move is being suggested to keep people from unhealthy choices like waiting to fill a prescription, filling a prescription too soon or buying larger quantities of medication in order to get something extra like coupons or loyalty points.

They also said they have witnessed people frequently switching between pharmacies, and leaving gaps in their medical information when doing so, simply to get the bonus points or gifts.

The college has not yet set a timeline for when they would like to see the prohibition take place but said they plan to focus on the proper implementation of the rules first.

Similar rules have already been used in Ontario, Newfoundland, PEI, Quebec and BC.

Obama s 2014 Science Budget Proposal Revitalizes STEM Education, Reduces Environmental Conservation

The President's plan for next year would give a boost to infrastructure, manufacturing and education in exchange for land conservation and environmental cleanup efforts

Among the winners in Pres. Barack Obama?s 2014 federal budget: the U.S. Geological Survey, Department of Education and National Science Foundation (NSF). The losers include agribusiness and the Environmental Protection Agency. Obama?s plan, announced April 11, is less a vision for a progressive science agenda than a reflection of political reality?specifically, the fact that he still must work with a conservative Congress. The budget gives a boost to science education and research, long-standing administration priorities. In a nod to fiscal conservatives it trims administrative costs and slashes subsidies for agribusiness. On the matter of fossil fuels, however, it largely maintains the status quo, preserving funding for drilling and fracking. Here?s a quick list of winners, losers and how the new White House budget would affect them.

The winners:

The Department of Education: Prioritizes science, technology, engineering and math (STEM) learning by creating a STEM Master Teaching Corps, an advisory group, as well as gives science research institutions a direct role in influencing curricula in K?12 schools and funneling young people to careers in those subjects. The $71-billion plan includes $7.6 billion for collaboration among the NSF, the Smithsonian Institution and schools from the K?12 through graduate levels.

Infrastructure: Centralizes specialized technical networks like electric power, transportation and water management into a unified $750-million cyber infrastructure system, enabling engineers to identify and address problems in the network instantaneously, and without disrupting other systems.

Manufacturing: Begins transitioning the U.S. to a ?new manufacturing economy? that would consist of a $1-billion network of interconnected manufacturing hubs. Hubs would link universities, high-tech manufacturers, service providers and tech start-ups.

The Fossil-Fuel Industry: Sets aside $421 million for carbon-capture-and-storage development in fossil-fuel technologies, an increase of nearly twice last year?s amount.

The U.S. Geological Survey: Dedicates $80 million for renewable energy research and development, including solar and wind projects, and $20 million for hydraulic fracturing, or fracking, the controversial drilling practice by which natural gas is extracted by shattering thick layers of underground shale with highly pressurized fluid. The allocation for fracking is a nearly 50 percent increase from last year.

The losers:

The Department of Agriculture: Slashes $38 million from Agriculture by eliminating subsidies for corn, soy, wheat and dairy?long considered an industry crutch to maintain consistently rising profit margins?as well as direct payments, allowances introduced with the intent of weaning farmers off traditional subsidies. The cut includes an $800-million reduction in farm bill conservation programs that encourage environmentally sound farming practices.

The Environmental Protection Agency: Cuts $3.7 billion from the EPA?s operating budget, a decrease of nearly 5 percent, and slashes state funds for clean water?reducing the Clean Water State Revolving Fund, a loan-assistance program for water quality improvement projects, by $1.2 billion. Superfund and brownfield cleanup programs will also be cut, losing $33 million.

To save endangered languages, tribes turn to tech

(AP) ? In a windowless conference room in a Las Vegas casino, about three dozen people are swishing their fingers across iPads, trying out test versions of new apps and screening for glitches.

But these are no Silicon Valley techies in town for one of the city's massive electronics shows. Many are from far-flung American Indian reservations, and their high-tech devices are serving a decidedly old-school purpose: trying to save their languages from the brink of extinction.

Experts say a growing number of tribes are trying to revitalize their languages, which in some cases are spoken by only a small handful of people. And increasingly, they're enlisting technology in the effort.

"We're in a race against time," said Lewis "Bleu" St. Cyr, 26, who attended the February workshop to scope out the possibility of developing a language learning app for the Winnebago Tribe of Nebraska. "The goal is for younger kids to get interested."

Linguists estimate about 200 Native American languages are spoken in the U.S. and Canada, with another 100 already extinct. In the early 1990s, experts estimated only 11 percent of tribal languages were still being passed traditionally from parents to children. The bulk of the surviving languages were spoken only by tribal members who were middle-aged or older.

Today, most tribes across the country are making some type of effort toward a language comeback, according to Leanne Hinton, a Berkeley linguistics professor and board member of the Advocates for Indigenous California Language Survival.

Those efforts include everything from apprenticeship programs that pair a fluent elder with a student, to immersion school programs. Many also incorporate technology such as YouTube videos of native speakers or Google Hangout video chats for live, long-distance conversations.

St. Cyr, who serves as media specialist for the Winnebago Tribe of Nebraska's Ho-Chunk Renaissance Program, says he's always on the lookout for creative ways to bring the Ho-Chunk language back to life. So far, he's worked up a language quiz game based on the show "Who Wants to be a Millionaire?" and has been using Facebook and YouTube videos to get young people engaged.

"The world is moving so fast with technology, and our youth are the ones who are going to carry the language on," he said. "I think it's received pretty well."

The Ho-Chunk language-learning app is the latest idea he's brought to the table. If tribal leaders give the OK, the tool could be circulated among the approximately 2,600 tribal members who live on the reservation, as well as those who have moved away.

Such apps are advantageous because they use technology that most young people already are well-acquainted with, said Don Thornton, whose Las Vegas-based tech company staged the February workshop.

Thornton Media is recognized as a leader in the tech side of indigenous language revitalization, developing translation devices, talking toys programmed in native languages and other tools over its 17-year lifespan. But Thornton says the biggest success has been custom apps for iPads and iPhones.

"It's the most flexible," he said. "Distribution is unlimited."

Since their first app teaching Cherokee came out in the iTunes store in 2009, Thornton says he and his wife have worked with 170 different tribes, representing 70 or 80 languages.

For about $22,000 plus the cost of travel, company employees will fly out to a tribe, record native speakers, and program the language into a 500-word or phrase app in about four days. They also can incorporate traditional songs and historical photographs.

While many tribes seem to be embracing the technology, the response wasn't always enthusiastic.

"When we started out, there was hesitance to use technology," Thornton said. "Sometimes people said it was the wrong way to go, that we should go straight through elders."

The company's next goal is to develop a video game that would require players to use a native language to survive in a virtual world. The first edition would be in Cherokee, which the Census Bureau estimates is spoken by about 12,000 people ages 5 and up.

Language revitalization advocates say they applaud the new technology, but note it's just one part of broader efforts that could include mentorship, classes and a community commitment to using tribal languages in daily life.

"It can be a very powerful tool in helping revive or revitalize endangered languages," said Inee Slaughter, executive director of the Indigenous Language Institute based in Santa Fe, N.M. "What we caution is that these are purely tools, and they do not substitute for a person's willpower and discipline to study and learn the language."

Slaughter, whose organization holds seminars on tribal language education and researches best practices for teachers, said she's witnessed a wave of interest in language renewal over the past two decades.

"It's gaining momentum very, very quickly," Slaughter said of the movement. "It's growing, and it's very encouraging."

Experts point to the early- to mid-1970s as the effort's start, and say it got a boost when the Native American Languages Act, passed in 1990, declared the U.S. was committed to ensuring the languages' survival. Federal funding for revitalization projects was added in 1992, allowing tribes to apply for competitive grants.

Money can help speed up the efforts, allowing tribes to hire language teachers or pay for apps. The Pechanga Band of Luiseno Indians in California uses funds from its casino to pay for Luiseno language courses at nearby California State University, San Bernardino.

The Winnebago Tribe of Nebraska, with its robust Ho-Chunk Renaissance program, also runs an award-winning economic development program and owns the WinnaVegas casino in Sloan, Iowa.

"There are definitely things you can do if you have more money," Hinton said. "But I also see tribes with plenty of money that don't do anything about language."

The most important ingredient, experts say, is willpower, and a love for the language.

Louise Davis, who lives in northern California, is almost tearful when she describes hearing people using the language of her Pit River tribe in conversation for the first time. It happened years ago when an older man from another part of the state met up with her grandmother.

It was such a powerful, emotional experience that Davis is driven to use flashcards at home with her children and do whatever it takes to preserve the language.

"You can say things in our language that you can't say in English," she said.

Testing out a language app in February, she said she couldn't wait to see it being used among young people in the tribe.

"To know your native language connects you to your community and your history," Slaughter said. "In the long run you are helping your community ... retain that cultural identity."
